Uh, I don't get it. Cobb could be extradited from France, he just claimed it would be difficult. Besides, I think it was implied that Cobb wanted to be able to go home, and no longer have to be a fugitive. I don't think this is actually a plot hole.

He is a fugitive from the law and I don't think it would be particularly safe/smart to move his kids from the US. This isn't a plot hole. He wanted his name and be able to see his children without still being a fugitive.

You're taking it a bit too literally, but it's a plothole in that he certainly could have seen his kids in France if he could see Caine there. Of course, he'd still be a big, superspecial fugitive, albeit one who a big, superspecial foreign entity could pick up a phone and help exonerate.

Did I mention if you go into a dream within a dream within a dream within a dream you get a free eggroll?
